WHAT IS ASSAULT?

According to the Texas penal code (Tex. Penal Code Ann. § 22.01), you can be charged with assault if you intentionally, knowingly, or recklessly:

  • Cause bodily injury,
  • Threaten someone, or
  • Cause physical contact when the person knows, or should reasonably believe, that the other will regard the contact as offensive of provocative.

The penal code specifies that these actions are considered assault when directed toward any other individual, including a spouse.
